Section 101(c) of NEPA provides in relevant part, β€œThe Congress recognizes that each person should enjoy a healthful environment . . . .” However, the author notes, β€œ[a]lthough the United States has enacted numerous laws to protect the environment and human health, courts, whether federal or state, have not rendered a decision establishing this as an express legal right.”
