Section 101(c) of NEPA provides in relevant part, βThe Congress recognizes that each person should enjoy a healthful environment . . . .β However, the author notes, β[a]lthough the United States has enacted numerous laws to protect the environment and human health, courts, whether federal or state, have not rendered a decision establishing this as an express legal right.β
