“Help!” said Toad: The Supreme Court Appears Divided on the Endangered Dusky Gopher Frog

The Supreme Court began the October term with Weyerhaeuser Co. v. U.S. Fish and Wildlife Service, a highly anticipated Endangered Species Act (ESA) case concerning the fate of the imperiled dusky gopher frog, which the U. S. Fish and Wildlife Service (FWS) determined as endangered in 2001. Final Rule to List the Mississippi Gopher Frog Distinct Population Segment of Dusky Gopher Frog as Endangered, 66 Fed. Reg. 62,993 (Dec. 4, 2001).
