Dear Colleagues,

Welcome to the April 2024 Just Resolutions newsletter sponsored by the Collaborative Law Committee. Our theme this year is “Why Collaborate to resolve conflict?”

You will find articles by Bob Merlin shining light on the Collaborative Law Act and the Resolution recently passed by the ABA House of Delegates validating the importance of this dispute resolution process, an article from Michael Sampson taking us to Florida and giving us a taste of the Collaborative Practice thriving in the south east, an article by our Fellow, Lynnore Seaton, addressing the important aspects of the Collaborative Process, and an article by Anita Dorczak inviting us all to reflect and cherish our deeply human values in collaborative negotiations.

As our late colleague and friend Kevin Scudder, the chair of our Committee the last two years, stated in his Introduction to our issue last year, “Our goal in presenting these articles is to educate members of the American Bar Association about Collaborative Practice so that we can all speak knowledgably about this consensual dispute resolution process with potential clients and within our legal community.” It remains our goal today.

Our committee’s mission is to:

  • explore the use of Collaborative Law (CL) in family and non-family settings
  • monitor and advise the Section Council about developments in the field
  • encourage the use of CL
  • help the Section build bridges with related organizations
  • and educate the Section, the ABA, and the public about the use of CL.

We hope you will enjoy reading the articles and we would like to invite you to join our committee and participate in our meetings so we could make the Collaborative Practice flourish as we continue to work on resolving disputes. If you wonder why? Well, you will need to delve into the contents of what follows after this Intro…
