Notwithstanding continuing advancements in data security and cyber breach defenses, cyber incidents, data breaches, and ransomware attacks are increasing. In response, various agencies—including the SEC, FTC, and CISA—have proposed or adopted additional laws, rules, and regulations regarding cyber risk governance, preparation, and disclosure requirements. These developments increase the critical importance for companies to have a cyber incident and response plan in place, as well as strong governance and disclosure regimes.
