Parties are often required to produce sensitive information. They could suffer financial harm/incur liability by the leak of such information. Despite robust security measures, data is only as safe as the litigating parties' weakest link. This program explores the ethical traps for counsel and clients; steps in-house counsel, outside counsel, and the courts can take to minimize risks; assignment of liability if a breach occurs; and how protective orders/confidentiality agreements can address these concerns.
