Companies in distress, whether the distress is financial, legal, or operational (or a combination thereof), present governance challenges and ethical issues. Boards and the attorneys that advise them are faced with new challenges and risks, possibly requiring changes in the board and/or its legal counsel. Our program explores distress situations, the ethical issues that those issues present, and how best to address them, including reference to the Model Rules of Professional Conduct (MRPC).
