Section 337 of the Tariff Act of 1933 prohibits unfair competition in import trade and provides U.S. industry with a means to bar foreign-made goods from the U.S. marketplace. This Article examines the advantages and disadvantages of a section 337 proceeding, the nature of section 337 relief, the requirements and procedures for obtaining such relief, and the current congressional attempts to simplify and liberalize section 337 proceedings.
