To ensure the enforcement of a confessed judgment, the creditor must closely follow the law of the jurisdiction, especially in a foreign jurisdiction. Although the Uniform Enforcement of Foreign Judgments Act has been adopted by almost every state, many states have enacted slightly modified versions. This Article discusses the legality and the enforceability of confessed judgment clauses in commercial transactions in the different jurisdictions.
