By affirming the Seventh Circuit’s opinion in FTI Consulting Inc. v. Merit Management, the Supreme Court overturned the law in five circuits to substantially narrow the scope of the section 546(e) safe harbor. In this program, the lawyers that brought the case will examine the implications of the Supreme Court’s decision, the direction of future section 546(e) litigation, and discuss some of the litigation strategies that led to the Supreme Court’s adoption of a narrow interpretation of the statute.
