All businesses are significantly affected by COVID-19, and financial services companies have particular concerns given the environment of extreme regulations.  This program will consider how to advise businesses about the legal implications of following issues:

  • Working in a Regulated Environment:
    • Remote employee supervision and other challenges of Work-from-Home
    • BSA/AML Challenges
    • Investigations, whistleblowers, and the litigation environment
    • Compensation plans, bonuses, and performance Appraisals
  • Return-to-Work Issues
    • Designing an appropriate safety plan: (i) clean-ups, temperature monitoring, contact tracing and more; (ii) implementing, maintaining and recording the safety plan including hazard assessments
    • Gearing up for re-hiring: (i) Whom do we rehire first?; (ii) Who is an “essential” employee?
  • Layoffs, furloughs, and terminations
    • What’s the difference and what’s the best approach
    • reduction in wages and unemployment benefits
    • WARN Act, Mini-WARNs, and other regulatory mandates
    • Impact on benefits; use of vacation and other leave times
