Ethics and Conflicts in Transactional Practice: Winter is Coming

This program will review of some of the fundamentals of recognizing, assessing, and dealing with conflicts of interest in a transactional practice. It will address the basic conflict rules (Rules 1.7, 1.9, and 1.10); the ethical and related issues when approached by a constituent of an organization to be formed or of an existing organization, including the consequences and limitations of representing the constituent, multiple constituents, or the organization itself; issues encountered when representing multiple clients in the same transaction; and the nuts and bolts of maintaining accurate information in a law firm’s conflict checking system.
