This panel will explore the post-retention process as it relates to the relationship between an attorney and an expert witness. Panelists will discuss a wide array of potential concerns that may arise once an expert has been retained on a case, from the viewpoint of both the attorney and the expert witness. The panel will also consider what role an expert search and referral service would play in these various scenarios and the potential benefits of turning the issues or problems over to an expert referral service to find a resolution.
The various issues to be discussed by the panel include, but are not limited to:
- Engagement documents: the necessity of clearly defined roles, rates and expectations
- The importance of regular attorney/expert communication on scope of work and budgets: “What we’ve got here is a failure to communicate!”
- Billing Disputes: if they can’t be avoided, taking proper steps to reach a resolution
- “The check’s in the mail”: ensuring timely payment from the underlying client to prevent work stoppages and delays
- Now what?: When an expert is no longer available (or a good fit), attorneys must pivot to save the case
