    Succession Planning and Unexpected Disabilities: Why You Need to Plan

    This CLE will focus on succession planning for the disabled lawyer. The disability could be physical or mental health related, or inability to continue in the practice of law, either voluntarily or involuntarily. As an Ethics CLE, the Model Rules of Professional Conduct and how the rules relate to common situations will be discussed.

    Learning Objectives:

    • This session will address the core Model Rules of Professional Conduct, including Model Rule 1.1 Competence, Comment 8 to Rule 1.1 regarding lawyer competence in technology, Model Rule 1.3 Diligence, Model Rule 1.4 Communication, Model Rule 1.5 Fees, and how the model rules relate to a situation where a lawyer is unable to practice due to a temporary or permanent disability.
    • The session will also address the Model Rules of Professional Conduct in the winding down, suspension or sale of a law office, which would be controlled by the Model Rules of Professional Conduct Rule 1.16 Declining or Terminating Representation, Model Rule 1.17 Sale of a Law Practice, as well as Model Rule 1.18 Duties to Prospective Clients.
    • This session will focus on planning in advance for possible worst-case scenarios. Lawyers must have a plan in place to protect their clients in case the lawyer has a sudden illness, injury or other situation that would prevent the lawyer from representing a client. The session will also discuss those times that a lawyer has not planned in advance, and the possible consequences to the lawyer, the client, staff and the lawyer's family.
