Since the Supreme Court severely restricted the use of race in college admissions in SFFA v. Harvard University, courts have had to grapple with how that case affects a variety of issues related to DEI initiatives. E.g., Am. All. for Equal Rts. v. Fearless Fund Mgmt. LLC, 103 F.4th 765 (11th Cir. 2024); Do No Harm v. Pfizer Inc., 96 F.4th 106, 112-129 (2d Cir. 2024). For example, the Eleventh Circuit Court of Appeals in Fearless Fund granted a preliminary injunction to prevent the Fearless Fund from administering a contest that would have awarded $20,000 grants to small businesses owned by Black women. In a 2-1 decision, the majority concluded that the Fearless Fund's contest is substantially likely to violate 42 U.S.C. 1981, which prohibits race discrimination in making and enforcing private contracts. Further, a series of lawsuits have forced some law firms to revise internship programs focused on minority students.
In this webinar, experienced DEI advocates will provide an update on anti-DEI trends percolating through the lower courts and anti-DEI initiatives in various states. In the process, speakers will discuss how anti-DEI litigation and initiatives are impacting the legal profession. Participants will leave with an understanding of this developing area of the law, a better understanding of how firms can use or continue DEI initiatives under current law, best practices for counseling clients on how to navigate this quickly changing legal landscape, and tips for litigating such cases.
