    Sociologists and linguists recognize that culture and language are intertwined, each reflecting the other and each are motivated by evolving society. Critique and evaluation of legal language is as old as the law itself. Recently, legal-writing scholars have focused on the role and purpose of inclusivity in legal language. In particular, there has been significant focus on bias-free and person-first language. These concepts, however, are resisted by many practitioners and other legal scholars. While the criticisms vary, they are often rooted in the adversarial nature of law practice and the need for persuasion.

    Attendees of this program will learn:

    • How inclusive language advances civility, in part, by focusing attention on a person's behavior rather than their identity (race, class, ability, ethnicity, gender, LGBTQIA+, religion, criminal history, etc.).
    • How civility to colleagues, adversaries, clients, and students is improved by inclusivity in legal language and usage.
    • How continued critical evaluation of legal language is necessary to unravel traditional hierarchies and to build new, stable standards that more accurately reflect and invite inclusivity in the legal profession.
    • How to choose more inclusive legal language.
