      Prosecutorial discretion is necessary for the operation of the criminal justice system. Prosecutorial decisions are often very complex requiring prosecutors to weigh and balance many factors surrounding all parties involved. Many of these details are often not publicly apparent. Prosecutors must remain independent so they can continue to promote public safety, serve the needs of their communities, and advance justice.

      In recent years, there is a push to remove, suspend, or substantially limit the authority of a chief prosecutors and some states allow for recall elections once the requisite number of signatures is garnered. Others permit the appointing authority to act if they have a basis to do so. Some states have created oversight commissions with the power to investigate complaints against local chief prosecutors and remove, suspend, or severely undermine their authority if there is sufficient cause.

      These efforts, and other actions by state actors around the country, which seek to curb a prosecutor's discretion raise serious concerns. When a prosecutor permits improper partisan or personal reasons, such as the threat of removal, into the decision of whether to charge a case, what charges to bring, and how to proceed, it undermines the public's confidence in our criminal justice system.
