    Guardianship has historically been posited as a benevolent, protective legal tool of last resort to assist people who are functionally unable to manage their affairs. As recent high-profile cases, like that of Britney Spears, have shown, in practice persons subject to guardianship often experience them as an overbroad removal of their rights that strips them of autonomy and dignity. Elder justice requires a balancing of these competing concerns, ensuring access to supportive guardians when needed and appropriate and limiting the unnecessary diminishment of rights where less restrictive supports exist.

    Once a guardianship proceeding has been initiated, effective representation of counsel may be the only thing standing between an older adult or person with a disability and the removal of their right to make fundamental decisions about their personal needs or property. In order for attorneys representing the respondent in a guardianship matter to be zealous advocates for their client, they need to be prepared to employ a holistic approach to representation, both inside and out of the courtroom, to ensure that guardianships orders are only put in place where the evidentiary standards are met and that the protective arrangement truly represents the least restrictive measure needed to assist the person.
