    This program provides information on how to prepare for a disaster. As climate change manifests there will be more and bigger disasters occurring every year. You, your family and your clients need to know how to protect themselves and others. This program will outline the the various federal policies and laws that guide disaster response (including the Stafford Act, The Disaster Mitigation Act, The Disaster Recovery Reform Act, etc.) and the protocol for creating disaster response plans with your clients.

    Disaster response in this county is founded in Treaties, Federal Statutes and Regulations, State Statutes and Regulations, and operating agreements among these three levels of government. Nationally the National Incident Management System developed by and for the Federal Emergency Management Agency guides all levels of government, non-governmental organizations, and the private sector to work together to prevent, protect against, mitigate, respond to, and recover from incidents.

    The Robert T. Stafford Disaster Relief and Emergency Assistance Act constitutes the statutory authority for most federal disaster response activities and established the presidential disaster declaration process. 42 U.S.C. 5121-5207 (the Stafford Act) Section 401 states in part that: "All requests for a declaration by the President that a major disaster exists shall be made by the Governor of the affected State". The Disaster Mitigation Act amended the Stafford Act and requires hazard mitigation plans as a pre-requisite for certain kinds of non-emergency disaster assistance. The Disaster Mitigation Act of 2000 also created the Pre-Disaster Mitigation Program and added incentives for states deemed "enhanced" who demonstrate increased coordination and integration of mitigation activities.

    On Oct. 5, 2018, President Trump signed the Disaster Recovery Reform Act of 2018 into law as part of the Federal Aviation Administration Reauthorization Act of 2018. These reforms acknowledge the shared responsibility for disaster response and recovery, aim to reduce the complexity of FEMA, and build the nation's capacity for the next catastrophic event. The American Red Cross is a major non-governmental organization that is included in these plans as dictated in individual State agreements.

    This webinar will address types of disasters, and how governmental agencies respond to these disasters using the framework described above. It is very important for individuals to understand these authorities so that they can adequately respond to emergencies when they occur. It is also important for Attorneys to counsel their clients on the role of these different organizations to make their clients safe during disasters.

    Attendees will:

    1. Understand the role of administrative agencies, the Executive branch, and the Military in responding to disasters as provided for in The Stafford Act, Earthquake Hazards Reduction Act of 1977, As Amended, The Weather Act, and other enabling legislation.
    2. Understand the effect of other laws on disaster response in this country (Americans with Disabilities Act, Federal Rehabilitation Act, Clean Air Act, Clean Water Act, Toxic Substances Control Act, Occupational Safety and Health Act, Railway Safety Act etc.)
    3. Understand the role of administrative agencies in forecasting disasters, (e.g., hurricanes, tornadoes, earthquakes, snowstorms). To know the difference between watches and warnings.
    4. Understand the role of nonprofit organizations within the national response program as provided for in legislation, bilateral agreements, and rules. (American Red Cross, Baptist Mens Group, Church of Later Day Saints Emergency Response program, etc.)
    5. Understand the role of the general public, as provided for in the laws listed above.
    6. Similar to end-of-life planning by elder law attorneys, be able to assist clients in developing a disaster response plan and determine when and how it should be implemented.
    7. Similar to Medicaid planning, be able to assist clients in obtaining benefits and resources that flow into a community after a disaster strikes by knowing the rules that dictate how the benefits and resources are distributed to the public.
