    The panelists will discuss the most significant provisions of construction contracts to provide a primer on reviewing these complex agreements for lawyers who do not regularly practice construction law. Among other things, the panelists will discuss various types of construction contracts, commonly used forms, various project pricing methods, progress and final payment considerations, insurance and indemnity issues, dispute resolution and force majeure issues.

    Therefore, it is important to understand the different types of construction agreements, the concepts behind the protections afford and the tradeoffs they include. In this session, panelists will discuss the differences between various types of construction documentation (such as a Design-Bid-Build vs a Design-Build structure), as well as how to negotiate effective warranties, insurance and indemnity clauses and protections from mechanic���s liens.

    The ABA will seek 1.5 hours of CLE credit in 60-minute states, and 1.8 hours of CLE credit for this program in 50-minute states*.
