    This CLE Webinar will focus on the developing landscape of COVID-19 Insurance coverage claims. Attorneys for both policyholders and insurance companies will examine the impact of recent judicial decisions; what to expect in future policy provisions as a result of COVID-19 claims and decisions and will review key coverage issues and arguments being advanced and challenged by policyholders and insurers.

    2-3pm EST: What Has to Be Proved and How

    Speakers: Andrew Downs and Adam Shwartzbaum

    The first hour of the program will dive into litigating Property Insurance COVID-19 Claims. The speakers are both Plaintiff and Defense counsel and will provide their experience in bringing and defending these claims. Attendees will learn from experienced attorneys in this field what needs to be proved to bring these claims and how.

    3-4pm EST: Decisions and Rationale

    The second hour of the program will dive into recent decisions and rationales from attorneys who are litigating these cases, their takes on the decisions, and the evolving landscape of Covid-19 cases.

    12-1pm EST: New Policy Provisions and What to Expect

    Speakers: Amy Currotto and Kyle Wong

    Attorneys will talk about the how the decisions and rationale in recent cases will impact future new policy provisions in regard to COVID-19 claims such as virus exclusions and ordinance in law. These attorneys will break down the possibilities of how insurance industry professionals may react to the recently decided decisions and rationale.

    1-2pmEST-: Ethical Issues of Inexperienced Attorneys

    Speakers: Judge Greg Holder and Kirsten K Davis

    Judge Greg Holder and Kirsten Davis, a professor of Ethics at Stetson, will explore the ethical issues of inexperienced attorneys or newer attorneys attempting to litigate these claims without any prior experience in Property Insurance and how that may violate Rule 3.3 of the Rules of Professional Responsibility.

    • Attendees will examine Rule 3.3 of the Professional Rules of Responsibility and how it pertains to new attorneys bringing COVID 19- Property Insurance Claims.
    • Attendees will reflect on whether attorneys outside the field of Property Insurance should jump in COVID-19 Property Insurance cases without the prior experience as a Property Insurance attorney.
    • Attendees will review how inexperienced attorneys litigating in this field can impact decisions and rationale.
