    Businesses across the country, and across the globe, have suffered devastating revenue losses as a result of the COVID-19 pandemic. A staggering number of lawsuits have been filed seeking rulings regarding the potential availability and scope of coverage for such losses under first-party policies' Business Interruption, Extra Expense, Civil or Military Authority, and other coverage grants. The panelists will discuss the myriad pandemic-related coverage issues, including what constitutes "direct physical loss or damage;" the potential applicability of virus exclusions, "loss of use" exclusions, and "loss of market" exclusions, as well as causation and valuation issues. They also will address new exclusions in the market regarding losses arising from communicable diseases.

    Emerging Issues in D&O Coverage

    This Program will discuss emerging and changing issues in Directors & Officers Liability Coverage, including discussion of the 9th Circuit's recent decision that excess insurers generally may not avoid or reduce their own liability by contesting payments made by underlying insurers, unless the payments were motivated by fraud or bad faith. The Panel will also discuss recent decisions applying Interrelated Wrongful Acts, the "bump up" exclusion, and the "dual capacity" exclusion. Finally, the Panel will consider the recent spate of lawsuits brought against companies and their directors and officers arising from the Covid-19 pandemic.

    Intersection of Insurance and Bankruptcy Law

    This panel will discuss many of the complex insurance issues that can arise in bankruptcy proceedings, such as the resolution of mass tort claims with trusts and channeling injunctions, access to D&O insurance proceeds, satisfaction of self-insured retentions, and bankruptcy stakeholders’ objections to policy buyback or coverage-in-place agreements as part of a chapter 11 plan of reorganization.
