The False Claims Act Virtual Trial Program
Day 1: July 7, 2020, 12:00 om - 2:00 pm EDT
•Observe and consider the overall trial themes selected by the parties to win over the jury in a complex area of law, starting with strategies in Voir dire proceedings and exercising challenges in jury selection. Next, identify how these approaches dovetail with the opening statements delivered by the plaintiff and defense to help guide the jury in understanding the key facts in the case, and their significance to the issues that support the respective position of the parties. Finally, the day ends with the judge's preliminary instructions about trial procedures and the role of the jury as the finder of fact in the case.
Day 2: July 8, 2020, 12:00 om - 2:00 pm EDT
•Watch how counsel for the plaintiff and defendant implement their strategies with witnesses in the case during direct and cross examination of the relator and his retained expert, a board-certified physician familiar with the long-term care industry and the applicable rules and regulations. Then, compare the witnesses for the defense: a state surveyor who independently audited the operations of the facility in question; and a nurse who worked for the company’s management, who is familiar with the facility's operations as well as the applicable rules and regulations.
Day 3: July 9, 2020, 12:00 om - 2:00 pm EDT
•During the decisive finale, notice how counsel for the plaintiff and defendant weave their trial strategies and themes, designed to sway jury evaluation of the evidence, in their closing arguments. Also, identify how they try to help guide the jury in determining key facts by referring to notable jury instructions. Attendees will get the rare opportunity to follow the jury's deliberations and learn which themes were successful, supported by comments and analysis from the participating attorneys, the jury consultants, and the federal judge.
