    Patentability of Computer-Implemented Inventions in Latin America [CC]

    In this webinar we will analyse from both conceptual and a practical viewpoints the most important issues when filing, prosecuting and enforcing Computer Implemented Inventions (CII) in Latin America, particularly in Argentina, Brazil and Mexico where the number of CII applications has been steadily growing but face several challenges.

    Among these challenges we will tackle the common wrong assumption about the exclusion of CII from patentable subject matter; the local definitions, or their absence, of technical character of the invention as well as the assessment of inventive step, among others that usually but not always follow the patentability standards established in the European Patent Convention, as more Latin American PTOs expand their international cooperation.

    José Santacroce: Partner and Head of Patent Department at Moeller IP 

    José has over 30 years of experience in the field of Intellectual Property. He joined Moeller’s Patent Department in 2018.

    For the majority of his career, he worked at the European Patent Office in Munich, Germany. He was a Patent Examiner in the field of Telecommunications for 17 years then  promoted to Director in the field of Computers (Human-Computer Interaction), managing 52 examiners for the last 12 years.

    Bringing his extensive managerial experience to Moeller, Jose leads a multidisciplinary team of highly qualified technical advisors, lawyers and paralegals in the day-to-day work of drafting, filing and prosecution of patents throughout the Latin American region.

    Furthermore, he is responsible for performance and quality management, training, reporting and recruitment. He ensures client satisfaction in all aspects of work within the Patent Department.

    He presented on the topic of Computer-Implemented Inventions at several international conferences.  In addition, he was a lecturer and instructor covering among other areas topics related to Patent Law and Computer-Implemented Inventions at the Chinese, Vietnamese, Philippine, Russian, Mexican, Brazilian, Argentine and Colombian Patent Offices within the framework of the WIPO and EPO International Technical Cooperation programs.

    He graduated with a degree in Electrical Engineering from Universidad Tecnológica Nacional Buenos Aires.

    Outside the office, José enjoys playing tennis, motorcycling, hiking and music.

    Mariano is an Argentine lawyer with more than 15 years of practical and academic experience dealing with the full range of IP issues locally (Argentina), regionally (Latin America) and internationally.

    He joined Moeller IP Advisors in 2005.  He has been advising clients in legal strategies related to the registration, protection and enforcement of patents, trademarks, domain names, advertisement claims, copyright as well as anti-counterfeiting, transfer of technology and regulatory affairs matters in Argentina, Latin America and other regions.

    In December 2018 Moeller's Board appointed him as the Head of the regional legal department, which followed becoming a partner in November 2017 and previous duties as Director of Business and Professional Development since early 2015.  One of his main extremal responsibilities is maintaining and expanding worldwide relationships with leading individuals, industries and institutions.

    Internally, Mariano leads the team of lawyers handling patent litigation, regulatory affairs and other complex transactional and adversarial services provided by Moeller regionally and internationally.

    Mariano regularly teaches different IP courses as an adjunct professor at Austral University, San Andres University (Argentina) and Chicago Kent (USA).  Lecture topics include Latin American Patent & Trademark Law, Sanitary Regulatory Affairs, The Madrid & Hague Systems for the International Registration of Rights, as well as IP Management and Innovation.

    His academic background is a Law degree with specialization on administrative law from the Universidad de Buenos Aires (Argentina, 2001).  In 2002, he became an Argentine IP Agent (2002).  He also completed a LLM in International IP Law with high honors from Chicago Kent (USA, 2004) then another LL.M. in Law and Economics from the Universidad Torcuato Di Tella (Argentina, 2008)
