    The National Center on Elder Abuse estimates that 1 in 10 Americans over the age of 60 have been the victim of abuse. Abuse comes in many forms. Potential victims are everywhere, in urban or rural settings, and are not limited to gender, culture or socio-economic status. Potential abusers can be family members, caretakers, attorneys in fact, friends, others, or institutional. Some estimate that financial exploitation of our elders, despite being vastly under-reported, exceeds $2.6 billion annually.

    Attorneys must be able to recognize who can be abused, who can be perpetrators and the warning signs of abuse, exploitation and neglect in its various forms.

    •Identify who can be abused.
    •Identify and Examine the types of Elder Abuse (i.e., physical, financial exploitation, neglect, emotional/psychological, etc.)
    •Identify and examine the types of abusers, who they are and how abuse is carried out
    •Recognize and describe warning signs or “red flags” of potential elder abuse for both the victims and perpetrators and how to respond

    For Ethics Consideration:

    What is an attorney’s ethical obligation when an attorney suspects abuse or suspects a client is abusing an elder? What if the attorney observes abusive behavior or suspects abuse and the attorney’s ethical obligations? Is there an ethical duty to report to authorities? What if an attorney learns of potential abuse in confidential client communications or meeting? What ethical issues arise when dealing with elders with diminished capacity as well as clients who are caring for an elder (with diminished capacity or other physical or other challenges) including, but not limited to, things to look for or examine when preparing instruments for an elder or on behalf of an elder (i.e., Durable Powers of Attorney, Health Care directives, etc.) and other practical ethical issues that might be useful to the attendee. The potential ethical issues faced by an attorney in elder abuse situations is not limited to the above, but attorneys need to be made aware of the potential for ethical issues.
