Environmental Project Failures (aka “Troubled Environmental Projects”)

Environmental remediation projects are actually construction projects; with a history of cost and schedule overruns. This session will explore why, over the past 30 plus years, site remediation projects and Brownfield development projects have had a history and a reputation for costing more than anticipated, taking longer to complete, generating claims and often resulting in complete failure. In this session, it will provide specific examples of the industry, experience and contract fundamentals that are not properly addressed and the risk assessment and management techniques and insurance options that can prevent and mitigate the impacts of these types of unsuccessful projects.
Everyone learns from their mistakes. If a provision of a contract that you drafted is aggressively litigated, you learn how to improve that provision. With this program, we provide you with examples of construction and remediation project "mistakes", which all too often experience problems with scope, schedule and budget leading to blown transactions, litigation and insurance claims. We will also provide concrete examples of how to negotiate better terms, draft stronger agreements and obtain meaningful and robust insurance for to best protect your clients (whether buyer, seller, developer, lender, contractor). The goal of this program is to arm you with real-world examples of both the common "mistakes" and the proven "fixes" for these types of projects.
