Hillary Stemple, an Associate in Arent Fox’s Health Care group, works extensively with clients on fraud and abuse and compliance-related matters. Her work includes assisting clients in determining whether they have an overpayment obligation, facilitating the reporting and returning of identified overpayments, and helping clients take proactive compliance measures to mitigate the risks of overpayment. In this webinar, Hillary will provide a brief overview of the 60-day Overpayment Rule and its intersection with the False Claims Act, followed by an in-depth discussion of recent updates and relevant cases and settlements in order to address those questions with which practitioners may still struggle. At the end of this session the participant will be able to:
(i) describe the overpayment report and requirements set forth in the Final Rule, including what it means to identify an overpayment and CMS's expectations for provider compliance programs;
(ii) understand the limitations of the Final Rule and questions the Final Rule leaves unanswered;
(iii) understand how providers can structure their compliance programs to ensure compliance with the 60-day rule;
(iv) understand the steps providers can take to resolve overpayments upon identification.
