    This webinar will further the ongoing debate of whether recent court decisions regarding the statutory defense to copyright infringement under 17 U.S.C § 107 have unduly limited, if not overridden, some of the exclusive rights in copyrighted works as set forth under 17 U.S.C. § 106. To that end, the panel will also discuss the four factors found in § 107 prescribed to determine whether the use made of a work in any particular case is a "fair use" and whether (and to what extent) "transformative use" considerations have skewed the balancing of those statutory factors.

    Some of the cases to be discussed include: Campbell v. Acuff-Rose Music, Inc., 510 U.S. 569 (1994); Seltzer v. Green Day, Inc., 725 F.3d 1170 (9th Cir. 2013); Brownmark Films, LLC v. Comedy Partners, 682 F.3d 687 (7th Cir. 2012); Cariou v. Prince, 714 F.3d 694 (2d Cir.2013); Kienitz v. Sconnie Nation LLC (7th Cir. 2014); and Hill v. PAUS (D. Colorado 2014).
