    Federal and stat antitrust enforcers sometimes disagree.

    This program will consider the instructive history of antitrust enforcement in the oil and gas sector, focusing particularly on the instances where federal and state enforcers have diverged in their decision-making.

    We will look in particular at the California AG's recent Valero action, discussing how the state AG took a different course from the federal enforcer. We will also discuss how best to counsel clients in a world where state AGs may take a different path than federal enforcers.

She is a former Federal Trade Commission attorney, and has a broad practice counseling clients regarding antitrust matters involved in mergers and acquisitions and concerning antitrust issues in licensing, distribution, pricing and competitor collaborations. She represents clients seeking merger clearance from the FTC and the U.S. Department of Justice, and clients that are third-party market participants subpoenaed by the government or that oppose an acquisition. Ms. Kazmerzak also works closely with co-counsel and economists around the world to develop the best global strategy for clients' advocacy across several jurisdictions, including in the U.S.0114

    I have practiced antitrust, trade regulation, consumer protection, constitutional and administrative law for the past forty plus years. I currently serve as the Chair of the Section's Janet D. Steiger Fellowship Project, and formerly served as the Section's Finance Officer, a Member of the Section's Council and as Chair of both State Enforcement and Consumer Protection Committees. I am a member of the James W. Cooper Fellows of the Connecticut Bar Foundation and a member of the American Bar Foundation. I am the co-author of a 1700+ page treatise entitled, "Unfair Trade Practices, Business Torts and Antitrust," Vol. 12, Conn. Prac. Series (Thomson Reuters). I have taught antitrust, consumer protection and constitutional law as an adjunct professor since 1979.
