It Takes Two to Modernize Antitrust, Delrahim Says, but Will Anything Really Change?
12 PM EST
Topic: On September 25, 2018, Assistant AG Makan Delrahim announced major changes to the merger review process to modernize it. Changes included a shortened merger review time, fewer custodians, fewer depositions, pull-and-refile accountability, among other changes---all in return for parties providing data and documents more quickly and removing any “gamesmanship.” But, what are the practical implications of this? If merger reviews are shortened, does it just push all the work to the pre-filing phase? Will this actually help companies save time and expense?
