The disruptive growth of online retail has had a major impact on competing retailers, suppliers, and consumers. How can (and should) the antitrust laws consider this development (if at all)? Is existing antitrust jurisprudence sufficiently broad enough to address any harm to the competitive process as online platforms increase in size and amass more data? Do we need to consider short-run and long-run effects separately? Given the rapid pace of disruptive innovation and change in this space, how can merger reviews properly consider online retail competition?
