    The interpretation of fair, reasonable, and non-discriminatory (“FRAND”) licensing commitments by the owners of standard essential patents (“SEPS”) continues to be a point of contention in high-profile cases and the subject of high-profile rulings, and these issues will be of increasing importance in emerging areas like autonomous automobiles and the Internet-of-Things.  Our knowledgeable panel will discuss their perspectives on the growing body of domestic and international guidance on FRAND licensing, including: 1) the responsibilities of licensors and licensees to actively engage in the licensing process; 2) methods for determining reasonable royalty rates for FRAND encumbered patents in a given jurisdiction and/or globally; 3) the meaning of the non-discrimination commitment; 4) the availability of injunctions for FRAND encumbered patents; and, 5) the pros and cons of the various domestic and international venues for asserting SEPs (e.g., ITC, District Court, arbitration, etc.).  The panel’s presentation will be followed by a question and answer session.

    The panel will include a representative from Powell Gilbert, Huawei Technologies Co. Ltd.’s U.K. counsel in the recent Unwired Planet Ltd. v. Huawei Technologies Co. Ltd., et al. matter.  The other panelists also have extensive experience licensing and litigating SEPs on behalf of a variety of companies, including: Nokia Corporation, Huawei Technologies Co. Ltd, ZTE Corporation, and SK hynix, Inc.
