    U.S. v. Energy Solutions -- Perspectives on Litigating Antitrust Merger Challenges

    The U.S. District Court for the District of Delaware recently issued its opinion in U.S. v. Energy Solutions, which enjoined the merger of two firms engaged in the disposal of low-level radioactive waste. The opinion is perhaps most noted for its discussion of the failing firm defense, but also addresses complex issues regarding product market definition, the potential for entry or expansion by other firms, and the role of economic evidence in merger litigation. Our panel includes attorneys for both sides of this litigation and a leading economist who has served as an expert for both the government and private parties to offer a multi-dimensional perspective on this decision.
