    This program will discuss the legal framework, recent developments and best practices for counseling on resale price maintenance (RPM) and related agreements. RPM is a vertical agreement setting the price at which a reseller will sell a supplier’s goods to downstream buyers. Alternatives to RPM include unilateral supplier policies conditioning its reseller relationships on reseller prices (a Colgate policy), vertical agreements affecting advertised prices rather than actual prices (MAP policies), or combinations of the two (unilateral MAP or UMAP). This program will update you on new litigation and enforcement efforts in these areas, as well as issues likely to be litigated in the future.
