In Phoebe Putney and North Carolina Dental, the Supreme Court clarified circumstances in which states and non-state actors are immune from antitrust enforcement. This panel will review those circumstances, more recent enforcement actions and states’ responses, including reviews of professional boards and regulations restricting competition, FTC Guidance and new state legislation extending antitrust immunity to merging parties.
