Antitrust and ITC: Friends, Foes or Unrelated?

The past few years have seen a lively debate on the role antitrust policy can play in the context of enforcing standard-essential patents (SEP) against infringers. Much of the debate has focused on enforcement of SEPs at the International Trade Commission (ITC) in Section 337 cases. What are the roots of the Section 337 statute? What are the statute’s public interest factors? Should antitrust policy play a role? A dream team panel of antitrust and ITC experts whose experience includes antitrust enforcement, ITC enforcement, academia, and private practice will discuss various aspects of these antitrust-intellectual property–trade intersection issues.
