    Most "Dis"-Favored Nations?: Recent Scrutiny of MFNs in the US and Abroad

    In the wake of recent challenges by government authorities and private plaintiffs of most favored nations (MFN) and MFN-like clauses in the health insurance, financial services, e-commerce, and other industries, companies and their counsel need to be aware of the potential antitrust risks posed by MFNs. Our panel of antitrust practitioners and academics will discuss recent enforcement actions in the U.S. and around the world focusing on the potential anticompetitive effects of these provisions, and will offer their perspectives on day-to-day client counseling with respect to MFN clauses.
