Navigating the Globe: the Competition & Markets Authority, Financial Conduct Authority and Competition Concurrency in the UK

This is the next chapter in a series examining critical issues for international cartel practitioners and will focus on updates relating to the UK Competition & Markets Authority (“CMA”) and the Financial Conduct Authority ("FCA"). The FCA obtained its full suite of concurrent competition powers in April of this year and recently published its Final Guidance on its competition powers and procedures. Our panel, which includes representatives from the CMA and FCA, in-house counsel and private practitioners in London and the US, will discuss how the two agencies will work with one another and the European Commission to enforce competition law.
The panel will also discuss practical issues relating to the requirement for firms to self report to the FCA possible “significant” infringements of “any applicable competition law” and potential cross-over with respect to leniency applications made to the CMA or FCA and consider the FCA’s approach to investigating and enforcing conduct that might breach both financial regulation and competition law.
