    The FTC's New Section 5 Policy Statement: A Step Forward?

    On August 13, 2015, the Federal Trade Commission issued a Policy Statement to clarify the antitrust principles that guide the Commission's application of its own standalone authority under Section 5 of the FTC Act. According to the FTC, the Statement—the first of its kind addressing “unfair methods of competition” in the statute's 101 year history—is an “important milestone in the Commission’s application of its founding statute.” Our experts will analyze the Policy Statement and discuss its practical implications for those practicing before the agency.
