    Federal Trade Commission v. Sysco Corporation: Food (Distribution) for Thought

    Following an expedited proceeding, the United States District Court for the District of Columbia has issued its decision granting the FTC’s request to preliminarily enjoin Sysco and US Foods from merging until the proposed combination is reviewed by an FTC Administrative Law Judge. In response to the decision, Sysco and US Foods have announced that they are abandoning their proposed merger. The panelists will discuss the legal arguments and economic theories considered by the Court, the merits of the parties’ respective positions, and the future impact of the recently issued decision.
