    Anchor Defendants and Jurisdictional Challenges in European Competition Damages Claims

    Three eminent European panelists will discuss recent and highly anticipated case-law developments in Europe focusing on matters of “territorial jurisdiction” in cross-border competition cases. They will consider the consolidation of claims before European Member State courts and the flexibility of the rules concerning anchor defendants, with particular reference to a recent Opinion issued by an Advocate General to the European Court of Justice in the Hydrogen Peroxide case. That Opinion for the first time considers, and reaches some potentially controversial conclusions about, how territorial jurisdiction should apply to cartel cases.
