The Meaning of a "Willing Licensee"

Antitrust enforcers in the United States, the European Union, and Korea have concluded that seeking injunctive relief against a "willing licensee" on a patent encumbered by a commitment to license on fair, reasonable, and nondiscriminatory (FRAND) terms raises unfair competition and antitrust concerns. While several courts and agencies have offered guidance on the meaning of a "willing licensee," it remains an ambiguous and contested term. A panel of international enforcers, in-house counsel, and law firm practitioners will discuss the meaning and legal implications of this important concept.
