The Department of Justice (DOJ) National Security Division (NSD) has recently made it clear that the Yates memorandum and resulting changes to the U.S. Attorney's Manual will govern prosecutions of export control and sanctions offenses, and has also indicated that NSD will likely issue guidance regarding voluntary disclosures that parties may make directly to DOJ in such cases. David Laufman, Chief, Counterintelligence and Export Control Section at NSD, DOJ has kindly agreed to discuss DOJ's enforcement of export control and sanctions laws, including DOJ's forthcoming VSD guidance, with members of our ECES committee in an informal brown bag lunch setting.
