      We?ve now had more than two months to digest the 2024 final Mental Health Parity and Addiction Equity Act (MHPAEA) regulations, and a clear consensus has begun to emerge: these rules are complex, granular, and will pose daunting compliance challenges. The new regulations establish detailed requirements relating to non-quantitative treatment limitations (NQTLs), which include an obligation to provide ?meaningful? mental health and substance use disorder benefits.

      They also prescribe:

      • A two-part test under which NQTLs are measured to ensure parity of mental health and substance use disorder benefits.
      • Detailed requirements for the content of required written NQTL analyses, including a new fiduciary certification requirement.
      • New requirements for analysis and documentation of ?relevant data? aiming to ensure actual outcomes are considered in analyzing parity.

      The program will provide an overview of the rules, an explanation of the rule?s effective dates, and recommendations for what plans and carriers must to do to ensure timely compliance, with a focus on the requirements effective as of January 1, 2025.
