This program will cover the process of mediation from the drafting stage to implementation and, ideally, resolution of a matter. Panelists will also discuss how to get something out of even a failed mediation.
You will learn:
• how one size does not fit all when including a dispute resolution clause in an agreement
• the importance of selecting the right mediator for the dispute at hand
• key considerations when preparing for mediation, including effective communication with the mediator
• what counsel should consider during a mediation to potentially get to "yes"
