Regarding RPC 2.1's mandate that a lawyer exercise independent professional judgment and render candid advice, considering not only legal but also moral, economic, social, and political factors, the panel will discuss:
• What this means and what mediators must know to counsel and to serve effectively
• What are the impediments to good judgment that mediators should know, and how to improve judgment and advice
• How to obtain the requisite holistic information, especially beyond the purely legal analysis, and how mediators can assist
• How mediators can properly consider and counsel on ADR alternatives
The panel also will address RPC 1.4's requirement that counsel promptly communicate all settlement offers to the client and clearly communicate risks and alternatives, and what the mediator's role is in facilitating informed consent.
