    National security considerations and concern are having an increasing effect on how bid protests are litigated. There has been an apparent rise in the number of protests involving classified procurements at the Court and GAO. Moreover, even in non-classified procurements, the advent and wide use of CUI designations by government agencies has had a marked effect on how information needs to be handled and safeguarded. The requirements for handling classified material and CUI impose additional obligations on top of those imposed by protective orders, and often require modification of standard protective order procedures. The impacts of classified material and CUI on protests is of course critical for protest practitioners (both government and private bar) to understand, but it is equally important for in house counsel to be ready to navigate the additional hurdles that often arise.
    Learning Objectives:
    At the conclusion of this session, attendees will be able to:
    1. Compare logistical considerations when preparing for a classified protest.
    2. Employ GAO practice and procedure for filing and litigating classified protests;
    3. Discuss and implement COFC practice and procedure for filing and litigating classified protests;
    4. Explain the requirements for handling Controlled Unclassified Information (CUI); Describe informal know-how involving the handling of classified protests.
