Health plans, health insurers, health care providers, their employer or union sponsors, and administrative and other services providers and subcontractors face expanding liability for participation in practices or arrangements that discriminate on the basis of race, color, national origin, age, disability, or sex as federal agency and private litigant enforcement of federal health equity rules like the newly updated final Patient Protection and Affordable Care section 1557 regulations announced April 26, 2024 (?2024 Section 1557 Rule?), the Civil Rights Act of 1964, the Americans with Disabilities Act, the Rehabilitation Act and other federal discrimination and equity rules.
Subject to injunctions of varying scope issued by three federal district courts, the 2024 1557 Rule now adds health insurers and certain self-insured or other group health plans receiving any funding from the Department of Health and Human Services, their administrators and subcontractors to the health care providers and other entities previously identified as covered by Section 1557?s civil rights rule and expands and tightens requirements for all covered entities while continuing its zealot enforcement of these and other health equity rules.
Heightened civil rights and other health equity risk isn?t limited to Section 1557-covered programs, however. Group health plans, their employer and union sponsors, insurers, and administrators also face their own expanding health equity responsibilities and risks as the Labor Department, Justice Department, HHS and other agencies use the ADA, Civil Rights Act, mental health parity and other federal discrimination and equity laws to advance their own health equity agenda.
Join Elizabeth Ysla Leight, Joanne Roskey, and Cynthia Marcotte Stamer for this important update on implications of the 2024 Section 1557 Rule and these other federal health equity regulatory and enforcement initiatives on health insurers, employment-based group health plans and their sponsors, and their administrators and subcontractors.
