Consumer Protection: Understanding Enforcement Actions Brought by State Attorneys General
While a laudable validation of treaties between the United States and Indian tribes, the decision of the Supreme Court in McGirt v. Oklahoma created unfortunate confusion as some states have attempted to avoid compliance, with the result that policing the borderlands is now more challenging than ever. In this informative webinar, our panel of experts will examine the practical and political calculations that have led to the destabilization of the borderlands.

Closed Captioned.
In June, 2020 the Supreme Court held that the Creek Nation's boundaries remained defined by treaty and had never been disestablished. The celebration had not ended before a blizzard of litigation erupted, led by Oklahoma's openly stated policy to undermine, water down, and cajole the Court into reversing the decision. The result is that in large sections of Oklahoma, courts and law enforcement are confused and vexed as uncertainty over the proper jurisdiction of criminal and traffic cases has increased the risk of unsafe roads.
The issue of state overreach is not limited to Oklahoma. In South Dakota, the Sisseton Wahpeton Oyate, Yankton Sioux, Cheyenne River Sioux, Oglala Sioux, Rosebud Sioux, and Standing Rock Sioux tribes have all, in one form or another, excluded Governor Kristi Noem from their lands because of her inflammatory rhetoric and attempts to expand state powers.
It doesn't have to be this way. In this informative webinar, our panel of experts will examine the practical and political calculations, both in Indian Country and in the states, that have led to the destabilization of the borderlands, and that might, as the Supreme Court predicted in McGirt, result in cooperation between partners. In so doing our panel will consider some other disputed jurisdictions such as Kashmir and Nagorno-Karabakh to see if any lessons can be applied to the 21st Century range wars.
