Chemical Product Law and Supply Chain Stewardship: A Guide to New TSCA

This program will discuss trends in climate change cases that are brought before judicial and quasi-judicial bodies, such as the UN Human Rights Council and the Assembly of the Council of Europe. While the U.S. leads global litigation on climate change matters, there are many significant international cases pending that are instructive to trends and future U.S. litigation and highlight differences in the legal tools available to climate litigation advocates.
The forums may vary, but the cases address similar key legal issues-for example, (1) whether the court has the power to resolve the dispute, such as in Peter Sabo et al. v. European Parliament and Council of the European Union 2020 or West Virginia v. EPA; (2) whether there is a legal source of an enforceable climate-related right or obligation, such as in Daniel Billy and others v Australia , and (3) whether the petitioner can identify those responsible for the alleged harm, such as in Milieudefensie et al. v Royal dutch Shellor the multiple U.S. state litigation against fossil fuel companies.
This program will examine global climate change litigation trends and key issues, including court jurisdiction, enforceable climate rights, and identifying responsible parties, by analyzing significant international cases and their implications for future U.S. litigation.
