      1. Attendees will learn to appreciate that, in the ever changing world of technological advancements, the Rules of Professional Conduct remain the same. As such, lawyers must comport their own use of any technological aids (including Generative AI) to the existing Rules of Professional Conduct.
      2. While the program will address any number of Rules of Professional Conduct, one of the most important is the lawyer's obligations under Rule 1.6 regarding a lawyer's ethical obligation to maintain the confidentiality of any information relating to the representation of a client. As such, an attorney must consider whether and how a client's information is being used or stored when the attorney uses Generative AI. The lawyer must also consider whether the client's informed consent is necessary when using Generative AI as a result of uploading or inputting client information. Attendees will be reminded of their ethical obligations regarding confidentiality and taking steps to ensure client confidentiality is maintained.
      3. Another of the important Rule of Professional Conduct applicable to Generative AI is Rule 1.1's ethical obligation to maintain competence. The attendee will be reminded that lawyers have an ethical obligation to keep up to date on developments in relevant technology (both the benefits and the risks) that are used (or can be used) in their practice. Competence with respect to Generative AI can involve not only understanding how to appropriately use the Generative AI platform, but knowing enough about the substantive law to either know that what is generated by the program is good and sound law, but even to know how to determine whether what is generated by the program is good and sound law.

      The ABA will seek 1.50 hours of CLE credit in 60-minute states, and 1.80 hours of CLE credit for this program in 50-minute states. Credit hours are estimated and are subject to each state's approval and credit rounding rules. Please visit the ABA MCLE website for general information on CLE.
